  1. Conditions of Sale 

1.1 The contract entered into between Gioielleria Pavan s.a.s. and the Customer must agree to be bound by the acceptance, even partial, of the order by Gioielleria Pavan s.a.s. The acceptance is deemed silent unless otherwise communicated to the Customer. Placing an order in the various ways provided, the Customer declares to have read all information provided to him during the purchase procedure, and to accept the Payment Terms below.

1.2 If the Customer is a consumer (ie a person who buys goods not related to their professional activity), after completing the online purchase procedure, he will print or save an electronic copy and in any case retain these general conditions in compliance with Legislative Decree 206/05 on distance sales.

1.3 Any Customer’s right to damages or compensation, as well as any contractual or non-contractual liability for direct or indirect damages to persons and / or things caused by the failure to accept, even partial, an order and misuse of the product, is excluded.

  1. Purchase Terms

2.1 Customer may only purchase the products in the electronic catalog of Gioielleria Pavan s.a.s when the order is forwarded and can be viewed online at as described in the Information Sheet. All the items sold on our store are “brand new”. It is understood that the image accompanying the descriptive card of a product may not be perfectly representative of its characteristics but differ according to color, size and accessories of the product in the picture.

2.2 The confirmation message will be sent by Gioielleria Pavan s.a.s. to the email address provided by the Customer.

2.3 In the case of non-acceptance of the order, Gioielleria Pavan s.a.s. ensures clear, well-timed communication to the Customer.

2.4 Orders for which the customer has chosen to pay by bank transfer will be shipped as soon as Gioielleria Pavan will receive the total payment of the purchase and any shipping charges. Gioielleria Pavan, therefore, invites the customer to pay for the item as soon as the order is received and, in any case, within the next 7 days. Over that period the order will be cancelled and the product made available online again.

  1. Payment methods  and Billing

3.1 Payment methods

3.1.1 Credit card: payment by Maestro, American Express, Visa with PAYPAL.

3.1.2 Early Bank Transfer: the purpose of the bank transfer must always include: a) the reference number of the order; (b) the delivery date of the order; c) the name and surname of the order holder.

3.2 Billing

In accordance with the articles 218 and 232 of Directive 2006/112 / EC on the common VAT system, the customer (whose residence is located in Italy) who needs the invoice of the order, he/she must make an explicit request by entering in the “Order notes” field during the payment – in the cart – the following data:

  1. SDI code;
  2. PEC address;
  3. VAT number;
  4. Invoice header and address.

For customers living abroad, it is not expected to issue the invoice but the receipt sent by email will be sufficient, and it can also be viewed in the personal account on in the Orders section.

  1. Methods and costs of delivery

4.1 Gioielleria Pavan s.a.s. only ship with DHL or UPS or Bartolini couriers, worldwide except for small restrictions.

4.2. Shipping costs will be charged by the Customer up to € 99.00 of expense, unless expressly stated promotions made during checkout. Exceeding this amount, the shipping costs will be fully charged by Gioielleria Pavan s.a.s.

4.3 No liability can be attributed to Gioielleria Pavan s.a.s. in case of delay in ordering or delivery of what is ordered.

4.4 At the time of delivery of the goods by the courier, the Customer is required to check:

(a) that the number of delivery packages corresponds to that indicated in the transport document;

(b) the packaging is intact, not damaged, neither wet nor otherwise altered, even in the closure materials (adhesive tape or metal strips).

4.5 Any damage to the packaging and / or the product or the lack of correspondence to the number of packages or indications must be immediately disputed, reported in the CONTROL RESERVE IN WRITTEN FORM (SPECIFYING THE RESERVE DECISON, eg. “packing”, “crushed packing “, etc.) on the POD (Proof of Delivery) of the courier. Once the POD is signed, the Customer will not be able to challenge any of the external features of the delivery.

4.6 Any problems regarding the physical integrity, completeness or correspondence of the products received with the information indicated in the order confirmation email (in particular the presence of instructions and warranty sheets) must be reported within 7 days of delivery, in accordance with the procedures set out in this document.

4.7 In case of non-withdrawal within 5 working days of the material,  in stock at the courier’s warehouses, because of repeated impossibility of delivery due to the absence of the consignee, the order will be returned to the warehouses of Gioielleria Pavan s.a.s., which will retain the amount corresponding to the cost of storage at courier’s warehouses and also the shipping costs.

4.8 In case of non-withdrawal of the goods within 3 months,  Gioielleria Pavan s.a.s. will consider them as abandoned goods, and will retain as penalty an amount equal to the cost of the goods and to the costs of delivery.

5. Right of withdrawal 

5.1 According to Legislative Decree 206/05 on distance sales, if the Customer is a consumer (ie a person who buys goods not related to their professional activity or does not make the purchase by indicating VAT Code in the order form), he will have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following points 5.3 and 5.5.

5.2 In order to exercise this right, the Customer must send to Gioielleria Pavan s.a.s. note of withdrawal within 14 working days from the date of delivery. This note must be sent by registered letter with acknowledgement of receipt, addressed to Gioielleria Pavan s.a.s. (with registered office in Via Pergolesi 8, Monza 20900). Upon receipt of this notice of withdrawal, Gioielleria Pavan s.a.s. will quickly inform the Customer of the return instructions. The goods must be returned intact, complete with all parts and original packaging (envelopes and packages), stored and – if necessary – used in accordance with normal care, without any signs of wear and tear or dirt, subject to the conditions of sections 5.3 and 5.5.

5.3 The right of withdrawal is however subject to the following conditions:

a) the right applies to the product purchased in its entirety (including the perfectly preserved package); it is not possible to exercise your right of withdrawal with only part of the purchased product;

b) the right does not apply to sealed audiovisual or software products (including those attached to hardware) when opened;

c) The purchased item must be intact and returned in its original packaging, complete in all its parts;

d) in accordance with the law, the shipping costs relating to the return of the goods shall be borne by the Customer; the Customer’s shipping costs (please click here to read the foreseen shipping expenses) and any other ancillary expenses evidenced at the time of order delivery will not be refunded;

e) the shipment, up to the certificate of receipt at the jewelry ‘s warehouses, is under the full responsibility of the Customer;

f) In case of damage to the goods during transport, Gioielleria Pavan s.a.s. will notify the Customer of the incident (within 5 working days of receipt of the goods in the warehouses) to allow him to promptly file a complaint letter against the courier and obtain the refund of the value of the good; in this case, the product will be made available to the Customer for its return, simultaneously canceling the request for withdrawal;

g) once the goods have arrived at the jewelry ‘s warehouses, the product will be tested to assess any damage or tampering due to the transport. If original packaging and / or packaging is damaged, Gioielleria Pavan s.a.s. will retain a percentage of the due repayment, however not more than 10% of it, as a contribution to the cost of restoration.

5.4 Subject to any restoration costs for damage of the original packaging, Gioielleria Pavan s.a.s. will repay to the Customer the entire amount already paid, within 14 days of the return of the goods in the jewelry ‘s warehouses, through the transfer procedure of the amount charged on the Credit Card or by Bank Transfer. In the latter case, it will be up to the Customer to provide timely bank coordinates (IBAN) on which to obtain the refund (the bank account must be addressed to the invoice holder).

5.5 The right of withdrawal shall cease wholly, in the absence of the essential condition of integrity of the good (packaging and / or its content), in cases where Gioielleria Pavan s.a.s. certifies: a) non-diligent use of the good that has compromised its integrity, or the use of any consumables; b) the absence of the outer packaging and / or of the original inner packaging; c) absence of integral parts of the product (accessories, manuals, parts, …); d) damage to the product for reasons other than its transport. In the event of a waiver of the right of withdrawal, the goods will remain at the Gioielleria Pavan s.a.s. at the Customer’s disposal for withdrawal.

  1. Guarantees

6.1 All products sold by Gioielleria Pavan s.a.s. are covered by the manufacturer’s conventional warranty and 24-month-warranty for conformity defects, according to the LD 24/02. In order to benefit from warranty service, the Customer will have to keep the warranty sheet in the original package as well as the invoice issued by Gioielleria Pavan s.a.s. To take advantage of commercial warranties, the Customer may request assistance to the Authorized Service Centers present in the territory and / or follow the procedures outlined in the documentation contained within the product packaging.

6.2 The conventional manufacturer’s warranty is provided in the manner described in the documentation contained within the product packaging. If, following intervention by an Authorized Service Center, the defect is not covered by the standard manufacturer warranty, Customer will be charged any costs of verification and repair required by the Authorized Assistance as well as shipping costs if supported by Gioielleria Pavan s.a.s.

6.3 The 24-month-warranty, according to the LD 24/02, applies to the product that has a defect of conformity, provided that the product itself is used correctly, in accordance with its intended use and with the provisions of the accompanying technical documentation. This guarantee is reserved to the private consumer (a natural person who buys the goods for purposes not related to his / her professional activity, or makes a purchase without specifying VAT Code in the order form). In the event of lack of conformity, Gioielleria Pavan s.a.s. provides, without charge to Customer, the restoration of product compliance by repairing / replacing or reducing the price until the termination of the contract. If, following an intervention by an Authorized Service Center, the defect does not result in a defect in compliance with LD 24/02, the Customer will be charged any costs of verification and repair required by the Authorized Assistance as well as the transport costs if incurred by Gioielleria Pavan s.a.s.

6.4 Replacement in case of DOA (Dead On Arrival: Product not working at delivery) is only effected if expressly provided by the manufacturer. Replacement or product repair times depend solely on manufacturer’s policies.

6.5 In the event that, for any reason, it is not possible to return a warranty product (repaired or replaced) to a Customer, Gioielleria Pavan s.a.s. may – at its own discretion  – pay back the amount paid considering the use of the good or replacing it with a product of the same or higher quality.

6.6 The repair or possible replacement of the product depends solely on the manufacturer’s policies and no damages can be claimed from Gioielleria Pavan s.a.s. for any delays in repairs or replacements.

6.7 In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete with all parts (including packaging and any documentation and ancillary equipment: manuals, etc.); To limit damage to the original packaging, we recommend inserting it into a second box; the adhesion of labels or adhesive tapes must be avoided in all cases directly on the original packaging of the product.

  1. Privacy

7.1 Personal data, required during the order transfer, are collected and processed in order to meet the express requests of the Customer and will in no case be transferred to any third party. Gioielleria Pavan s.a.s. guarantees to its Customers the respect of the rules on the treatment of personal data, governed by the privacy code of Legislative Decree 196 /2003.

7.2 The data controller owner is Gioielleria Pavan s.a.s.  with registered office in Via Pergolesi 8, Monza 20900.

  1. Complaints

Any complaint should be addressed to Gioielleria Pavan s.a.s. by registered letter with acknowledgment of receipt at the following address: Gioielleria Pavan s.a.s. Via Pergolesi, 8 – 20900 – Monza.

  1. Applicable law

The sales contract between the Customer and Gioielleria Pavan s.a.s. is understood to be concluded in Italy and governed by the Italian Law.
